Each stage of the development consent order process starting on 5 December 2018.

Lake Lothing Third Crossing

The public had until 24 September 2018 to register with the Planning Inspectorate to become an Interested Party by making a Relevant Representation. A Relevant Representation is a summary of a person’s views on an application, made in writing.

An Examining Authority is also appointed at the pre-examination stage.

All interested parties will be invited to attend a preliminary meeting, run and chaired by the Examining Authority.

The purpose of the preliminary meeting is to enable views to be put to the Examining Authority about the way in which the application is to be examined. At this stage the Panel is looking at the procedure and not the merits of the application. The merits of the application will only be considered once the Examination starts; which is after the Preliminary Meeting has closed.

If you are not an interested party that has already made a Relevant Representation and wish to attend the preliminary meeting you will need to contact the Case Team no later than Wednesday 28 November 2018.

At the close of this preliminary meeting, the Examination stage begins.

How to take part at a Preliminary Meeting

The purpose of an open floor hearing is to allow interested parties to address the Examining Authority on relevant matters of their choosing. 

Parties who do not register in advance may be heard at the end of the hearing if there is time available and at the discretion of the Examining Authority.

If you wish to make oral representations at this hearing you will need to contact the Case Team no later than Wednesday 28 November 2018.

The Planning Inspectorate has up to six months to carry out the examination.

During this stage Interested Parties are invited to provide more details of their views in writing.

Careful consideration is given by the Examining Authority to all the important and relevant matters including the representations of all Interested Parties, any supporting evidence submitted, and answers provided to the Examining Authority’s questions set out in writing or posed at hearings.

Details of hearings and meetings during the Examination stage will be advertised on suffolk.gov.uk, in local media or at local venues.

Recommendation: Planning Inspectorate report

Approximately 5 June to 5 September 2019

The Planning Inspectorate must prepare a report on the application to the relevant Secretary of State, including a recommendation, within three months of the close of the six month Examination stage.

Decision: Secretary of State determination

Approximately 5 September to 5 December 2019

The relevant Secretary of State then has a further three months to make the decision on whether to grant or refuse development consent.

Post decision

Approximately 5 December 2019 to 16 January 2020

Once a decision has been issued by the relevant Secretary of State, there is a six week period in which the lawfulness of the decision may be challenged in the High Court.
